These terms apply when you use XPortal, this website or the XPortal plugin for ChatGPT.

About these terms

XPortal is provided by Aberdeen & Associates. By using XPortal you agree to these terms. If your organisation has a signed agreement with us, that agreement applies first wherever it differs from these terms.

Accounts

XPortal accounts are created by a training organisation for its staff, trainers, agents and students. You must be authorised by that organisation to use the account you sign in with.

Keep your sign-in details and authenticator to yourself, and tell your organisation or us straight away if you think someone else has used your account.

Your organisation’s data

The organisation owns the data it puts into XPortal and is responsible for having the right to collect and use it, including any consent its students must give. We use that data only to provide XPortal, as our privacy policy describes.

Acceptable use

Do not:

  • use XPortal to break the law or anyone’s rights;
  • try to reach another organisation’s data or get around security controls;
  • upload malware or disrupt the service; or
  • resell or copy XPortal without our written agreement.

The XPortal plugin for ChatGPT

The plugin lets staff lodge student applications from ChatGPT. It is optional and works only for XPortal staff accounts.

ChatGPT is provided by OpenAI under OpenAI’s own terms. An AI assistant can misunderstand or make mistakes, so check the review XPortal shows before you confirm a submission. You remain responsible for what you submit.

Only enter information about a person in ChatGPT if your organisation permits it. Identifiers and sensitive answers can always be entered in XPortal instead.

We may change, limit or withdraw the plugin.

Connected services

XPortal can connect to services run by others, such as accounting, payment, email and messaging providers. Their terms apply to your use of them, and we are not responsible for them.

Fees

Fees for XPortal are set out in your organisation’s agreement with us.

Availability and changes

We work to keep XPortal available and secure, but we do not promise it will be uninterrupted or free of errors. We may change XPortal as we improve it, and we will give organisations reasonable notice of a change that removes something they rely on.

Liability

Nothing in these terms limits rights you have under the Australian Consumer Law that cannot be excluded. Beyond those rights, and to the extent the law allows, XPortal is provided as is, we are not liable for indirect or consequential loss, and our total liability is limited to the fees your organisation paid us in the 12 months before the claim.

Ending use

An organisation can stop using XPortal as its agreement allows. We may suspend an account that breaks these terms or puts the service or other organisations at risk.

Governing law and changes

These terms are governed by the laws of New South Wales, Australia. We may update them; the date at the top shows the latest version, and continuing to use XPortal after a change means you accept it.
